Energy Litigation

We handle complex litigation, arbitrations, internal investigations, and appeals for some of the nation’s leading energy companies.

Our clients include energy technology and services companies, utilities, producers and suppliers, and regional transmission operators. Our experience runs the gamut from representing joint-venture participants in breach-of-contract disputes to litigating the application of the filed-rate doctrine to state-law claims. We represent interested parties in appeals from FERC orders. We challenge administrative rulemakings. And we handle bankruptcy and intellectual-property disputes that arise in the energy sector.

We appear in state and federal trial courts, before arbitral tribunals, in the federal courts of appeals, and in the U.S. Supreme Court. While we handle matters from their inception, we are often retained as co-counsel in proceedings where a client wants an additional perspective or seeks to position a case for appeal. Our team includes seasoned trial and appellate lawyers with experience handling energy cases.

We also advise clients before disputes arise. We help businesses assess and mitigate litigation and arbitration risk, evaluate the strength of contemplated lawsuits and appeals, and develop legal strategies aligned with their business objectives.

Our attorneys understand the complex markets and regulatory regimes our clients face. We find, however, that our success results from the advocacy skills we bring to the table. We work closely with in-house legal, technical, and business teams, while remaining focused on translating complex energy markets and technologies into persuasive stories, anchored in the law, that resonate with judges, arbitrators, and juries.

Because we focus exclusively on litigation, we have fewer conflicts than firms with full-service energy practices. That gives us the tactical flexibility to take on matters adverse to major industry participants. And our experience on both sides of the “v” informs our thinking and makes us more effective, whichever side we represent.
