ML wins Federal Circuit victory for client Ericsson in closely-watched appeal

In a victory for our client Ericsson, the Federal Circuit ruled that Ericsson is entitled to a jury trial in its patent-royalty dispute with Chinese phone maker TCL.  The ruling overturns a judgment of the trial court, reached after a bench trial, that found Ericsson’s license offers to TCL were not “fair, reasonable, and non-discriminatory” and established its own royalty rates for Ericsson’s patents on 2G, 3G, and 4G/LTE technology.
